Overview of the Subclass 491 Visa

The Subclass 491 Skilled Work Regional (Provisional) visa is a five-year skilled visa that enables applicants to live and work in a designated regional area of Australia. It also serves as the gateway to permanent residency through the Subclass 191 Permanent Residence (Skilled Regional) visa.

To qualify for the Subclass 191 visa, applicants must meet the Commonwealth’s regional residence and taxable income requirements over a continuous three-year period. These requirements are assessed solely by the Department of Home Affairs and apply uniformly to all Subclass 491 visa holders regardless of the state nomination pathway used.

The Small Business Owner pathways offered by Tasmania and Queensland provide a nomination mechanism only. They do not replace or amend the Commonwealth’s permanent residency requirements.

Staged Application Process

Applicants using a Small Business Owner pathway generally progress through three stages.

Stage 1
The applicant must hold a substantive visa that grants full work rights. This commonly includes a Temporary Graduate visa or a secondary position on an employer-sponsored visa.

Stage 2
An Expression of Interest or Registration of Interest is lodged with the relevant state. Once state nomination is granted, the Subclass 491 visa application must be lodged within sixty days.

Stage 3
After meeting the residence and taxable income requirements over three years, the applicant becomes eligible to lodge the Subclass 191 visa application.

Commonwealth Eligibility Requirements

All Subclass 491 applicants, including those pursuing a Small Business Owner pathway, must satisfy the Department of Home Affairs criteria:

  • Lodge an EOI or ROI and receive an invitation
  • Obtain state nomination
  • Hold a positive skills assessment in an eligible occupation
  • Be under 45 years of age at the time of invitation
  • Demonstrate Competent English
  • Achieve at least 65 points, inclusive of nomination points
  • Meet health and character requirements
  • Be in Australia when applying
  • Ensure the business operates in the nominating state

Skills assessments must be issued by the designated assessing authority and confirm that the applicant’s qualifications and experience align with the nominated occupation.

State Pathways

Both Tasmania and Queensland administer distinct Small Business Owner programs. Applicants must meet all state-specific requirements to obtain a nomination.

Tasmania: Tasmanian Business Operator Pathway (TBO)

Tasmania has adopted a detailed and structured nomination pathway known as the Tasmanian Business Operator Pathway. Key requirements include:

  • Operating a business in Tasmania for at least twelve months
  • Holding ownership solely or jointly with a spouse or partner
  • Demonstrating that the business is profitable after paying the applicant an appropriate wage
  • Completion of Fair Work Ombudsman online learning modules
  • Maintaining a business that is physically located and genuinely trading in Tasmania
  • Ensuring the business is not based on subcontracting or independent contractor arrangements

Registrations of Interest are ranked based on priority attributes such as turnover, personal income from the business, local job creation, duration of residence in Tasmania and the applicant’s qualifications.

Documentary evidence typically required includes bank statements, BAS lodgements, tax records, commercial lease agreements, proof of residence in Tasmania and evidence of ongoing business operations.

Queensland: Small Business Owner Stream

Queensland administers a highly prescriptive Small Business Owner nomination stream. Applicants must satisfy the following criteria:

  • Hold full work rights in Australia at the time of application
  • Purchase an existing business in regional Queensland
  • Exclusions apply to startups and home-based businesses
  • Franchise purchases are only eligible if the business has operated for at least twelve months prior to sale
  • Invest a minimum of 100,000 dollars before lodging the EOI
  • Maintain one hundred percent business ownership
  • Operate the business for at least six months prior to applying
  • Employ at least one Australian citizen or permanent resident for twenty hours per week or equivalent job share
  • Employees must not be relatives or subcontractors
  • Show evidence of sufficient settlement funds

Queensland documentation requirements

Queensland requires extensive documentation, including:

  • Passport identification and VEVO details
  • Positive skills assessment
  • Completed 491 Small Business Owner Application form
  • Business sale contract, settlement documents and evidence of funds transfer
  • Financial statements, BAS lodgements and business bank statements
  • Payroll evidence, including payslips and PAYG summaries
  • Employment contracts for Australian staff
  • Commercial lease documentation and photographic evidence of business premises
  • Where applicable, audited financial records or BAS demonstrating turnover of at least 200,000 dollars for startup-related assessments

Queensland may request additional evidence and conduct strict compliance checks.

Key Considerations

The Small Business Owner pathways offered by Tasmania and Queensland are designed for applicants who are already onshore and hold a visa that permits unrestricted work rights. The business must be genuine, financially viable and actively trading, with evidence that the applicant plays a central managerial and operational role in the enterprise.

Both states expect substantial documentation and undertake careful verification of business activity. Assessment bodies regularly review financial records, taxation documentation, trading evidence, premises details and staffing arrangements. Applications that are not supported by consistent and reliable evidence are rarely successful.

State nomination is not an approval of the Subclass 491 visa. The Department of Home Affairs independently assesses the visa application and ensures that all legislative criteria are met. Some states also undertake post-nomination monitoring to ensure the business continues to operate as represented.

Permanent residency through the Subclass 191 visa is not automatic. Applicants must meet the Commonwealth’s residence and taxable income requirements over a three year period. As a result, long-term business planning, accurate financial reporting and stable trading performance are essential to ensure eligibility at both the provisional and permanent stages of the skilled migration process.
